Lesbian Couple in Alabama Denied Adoption Petition
Just when you think the fight is over, there’s one more battle. The lesbian couple whose lawsuit overturned Alabama’s same-sex marriage law are back in court, and this time it’s to fight for an adoption petition refused by a probate judge.
Kim McKeand and Cari Searcy, who have been together for 16 years, were responsible for filing the lawsuit that lead to U.S District Judge Callie Granade to rule Alabama’s same-sex marriage ban unconstitutional back in January. Now despite being legally married (in California) the two were denied the right to legally adopt their nine-year-old son because they aren’t legally considered spouses under Alabama state law…
In the meantime the couple was granted an “interlocutory decree,” which gives them temporary parental rights of their son; however, they were told no official decision would be made until the U.S. Supreme Court made its nationwide ruling on the four same-sex marriage cases before it.
